ASSUMPTION OF RISK, WAIVER & RELEASE OF LIABILITY **Gymnastics and related activities involve inherent risks. Please read this agreement carefully before accepting. By accepting this agreement, you acknowledge and assume certain risks and waive certain legal rights on behalf of yourself and the Participant.** This agreement applies to participation in classes, training, programs, camps, clinics, open gyms, parties, events, competitions, exhibitions, and other activities offered, sponsored, or supervised by Bakersfield Gymnastics Academy (“BGA”). 👤 **Parent/Legal Guardian Authority** I represent that I am the Participant’s **parent or legal guardian** and have the legal authority to enter into this agreement and provide the acknowledgments, releases, and authorizations contained herein on the Participant’s behalf. I understand that only a parent or legal guardian may accept this waiver on behalf of a minor Participant. ❤️ **Participant Health & Ability to Participate** I understand the physical nature of gymnastics, tumbling, conditioning, stretching, and related activities. To the best of my knowledge, the Participant is physically capable of participating in BGA programs and activities. I am responsible for informing BGA of any injury, medical condition, physical limitation, allergy, or other information reasonably necessary for BGA staff to safely supervise the Participant. I understand that BGA does not determine whether a Participant is medically fit to participate and that I am responsible for obtaining medical advice or clearance when appropriate. ⚠️ **Acknowledgment of Risks** I understand that gymnastics, tumbling, physical conditioning, stretching, and related activities involve **inherent and other reasonably foreseeable risks that cannot be completely eliminated**, even when reasonable safety precautions are taken. Risks may include, but are not limited to: - Falls, slips, trips, or loss of balance - Collisions with participants, coaches, equipment, floors, walls, or other objects - Improper, awkward, or unexpected landings - Equipment movement, malfunction, or failure - Overexertion, fatigue, or physical strain - Strains, sprains, bruises, cuts, and other soft-tissue injuries - Broken bones, fractures, or dislocations - Concussions and other head injuries - Neck, back, or spinal injuries - Paralysis - Other serious, permanent, catastrophic, or fatal injuries I understand that injuries may occur while learning or practicing skills; performing drills; conditioning or stretching; being spotted; mounting, using, or dismounting equipment; participating in games or activities; entering or leaving activity areas; or otherwise participating in BGA programs and activities. ✅ **Voluntary Assumption of Risk** I voluntarily choose to allow the Participant to participate in BGA programs and activities with knowledge of the risks associated with participation. I knowingly and voluntarily assume, on behalf of myself and the Participant, the inherent and reasonably foreseeable risks associated with participation in BGA programs and activities. ⚖️ **Waiver & Release of Liability** **To the fullest extent permitted by California law**, I, on behalf of myself and the Participant, and our respective heirs, representatives, and assigns, release and waive claims against Bakersfield Gymnastics Academy and its owners, directors, officers, employees, coaches, instructors, agents, and representatives (collectively, the “Released Parties”) arising out of or relating to the Participant’s participation in BGA programs or activities, **including claims arising from the ordinary negligence of a Released Party**. This waiver and release applies to claims for personal injury, bodily injury, property damage, or death to the fullest extent such claims may lawfully be released under California law. **This agreement does not release or waive liability that cannot lawfully be released or waived under California law**, including liability arising from gross negligence, reckless or willful misconduct, or other conduct for which liability cannot legally be released. 🚑 **Emergency Medical Care** If the Participant becomes injured, ill, or requires emergency assistance while participating in a BGA program or activity, I authorize BGA staff to obtain reasonable emergency medical assistance when BGA determines such assistance may be necessary and a parent or legal guardian cannot be reached immediately. I understand that BGA staff are not medical professionals and may contact emergency medical services when appropriate. I accept financial responsibility for medical treatment, emergency transportation, or other medical services provided to the Participant, except to the extent responsibility is otherwise imposed by applicable law. 🛡️ **Safety Rules & Participation** The Participant is required to follow BGA safety rules and the instructions of BGA coaches and staff. I understand that BGA may stop, restrict, or discontinue the Participant’s participation when BGA reasonably determines that continued participation presents a safety concern to the Participant, another participant, BGA staff, or others. I understand that compliance with safety rules and staff instructions does not eliminate all risks associated with gymnastics and related activities. 📍 **Scope of Agreement** This agreement applies to the Participant’s participation in BGA classes, training, programs, camps, clinics, open gyms, parties, events, competitions, exhibitions, and other BGA-sponsored or supervised activities. It applies whether an activity occurs: - At BGA’s facility - At another gymnastics facility - At a competition or event venue - At another location as part of a BGA-sponsored or supervised activity This agreement is intended to apply to the Participant’s current and future participation in BGA programs and activities unless replaced or revoked to the extent permitted by applicable law. 📄 **Severability** If any provision of this agreement is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect. ✍️ **Acknowledgment & Agreement** By accepting this agreement, I acknowledge and agree that: - I have carefully read this **Assumption of Risk, Waiver & Release of Liability** - I understand its contents - I understand that participation in gymnastics and related activities involves risks of serious injury, including catastrophic injury or death - I voluntarily assume the risks described in this agreement - I understand that I am releasing certain legal claims, **including claims arising from the ordinary negligence of the Released Parties**, to the fullest extent permitted by California law - I am the Participant’s parent or legal guardian and have authority to enter into this agreement on the Participant’s behalf - The information I have provided to BGA is accurate to the best of my knowledge **I HAVE READ, UNDERSTAND, AND VOLUNTARILY AGREE TO THIS ASSUMPTION OF RISK, WAIVER & RELEASE OF LIABILITY.**

PHOTO, VIDEO & MEDIA RELEASE **BGA may photograph or record athletes during classes, events, and other activities for promotional, educational, and informational purposes. This authorization is voluntary and is not required for participation in BGA programs.** 👤 **Parent/Legal Guardian Authorization** I represent that I am the Participant’s **parent or legal guardian** and have the legal authority to provide the permissions and authorizations contained in this agreement on the Participant’s behalf. 📸 **Photography & Recording** I authorize Bakersfield Gymnastics Academy (“BGA”) to photograph, video record, and/or audio record the Participant while participating in BGA activities. This may include: - Classes and training - Camps and clinics - Open gyms and special events - Parties - Competitions and exhibitions - Team activities and practices - Other BGA-sponsored or supervised activities 📱 **Use of Photos & Media** I authorize BGA to use photographs, videos, audio recordings, and other media containing the Participant’s **image, likeness, or voice** for legitimate BGA promotional, marketing, educational, and informational purposes. Media may be used in: - BGA’s website - BGA-managed social media accounts - Digital and print advertising - Promotional photographs and videos - Flyers, brochures, banners, signage, and other printed materials - Email and other BGA communications - Other BGA-operated promotional or informational materials ✂️ **Editing & Publication** I understand that BGA may edit, crop, resize, reproduce, publish, display, or otherwise prepare approved photographs and recordings for the purposes described above. I understand that I will **not receive compensation** for BGA’s authorized use of these photographs, recordings, or other media. 🔒 **Participant Privacy** BGA will not identify a minor Participant by their **full name in public-facing promotional or marketing materials** without separate permission from the Participant’s parent or legal guardian. I understand that photographs or recordings may nevertheless contain information that could make a Participant recognizable, including their appearance, team affiliation, uniform, competition participation, or the context in which the photograph or recording was taken. ✅ **Voluntary Authorization** I understand that this authorization is **voluntary**. Permission to photograph or record the Participant for promotional or marketing purposes is **not required for participation in BGA’s regular programs**, and declining this authorization will not affect the Participant’s eligibility to enroll or participate. I understand that BGA may still use photography or video for legitimate internal, safety, instructional, documentation, or operational purposes when permitted by applicable law and BGA policy. 🔄 **Withdrawal of Authorization** I may withdraw this authorization for **future photography, recording, and use** by providing written notice to BGA. Withdrawal will apply after BGA receives and processes the request. I understand that withdrawing authorization does not require BGA to recall, destroy, or remove materials that were lawfully created, published, printed, distributed, posted, or otherwise used before BGA received and processed my withdrawal request. I also understand that BGA may not be able to remove copies of previously published materials that have been shared, reposted, downloaded, archived, or otherwise distributed by third parties outside of BGA’s control. ✍️ **Acknowledgment & Agreement** By accepting this agreement, I acknowledge and agree that: - I have read and understand this **Photo, Video & Media Release** - I voluntarily authorize BGA to photograph and/or record the Participant as described above - I authorize BGA to use approved media for the purposes described above - I understand that I will not receive compensation for authorized use - I understand how to withdraw authorization for future photography, recording, and use - I am the Participant’s parent or legal guardian and have authority to provide this authorization on the Participant’s behalf **I HAVE READ, UNDERSTAND, AND VOLUNTARILY AGREE TO THE PHOTO, VIDEO & MEDIA RELEASE.**
